DMCA Policy

DramaTalks respects the intellectual property of others and expects its members to do the same. We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA), and we handle notices from rights holders in any other country the same way.

1. Filing a takedown notice

Send us a written notice that includes all of the following. A notice that leaves something out may take longer to act on.

  1. The copyrighted work. Identify the work you believe has been infringed. If one notice covers several works, a representative list is enough.
  2. Where it appears. The address of each page on DramaTalks where the material appears, such as https://dramatalks.com/videos/…, or the drama’s title exactly as the Service shows it, so that we can find the exact material.
  3. Your contact details. Your full legal name, postal address, telephone number and email address.
  4. A good-faith statement that you believe the use of the material is not authorised by the copyright owner, its agent, or the law.
  5. An accuracy statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.
  6. Your signature, physical or electronic, or that of a person authorised to act for you.

2. Where to send it

Email your notice to [email protected] with the subject “DMCA Takedown Notice”. Notices sent anywhere else, such as our Facebook Page or our Telegram bot, may not reach the right person.

3. What happens next

  • We reply to confirm that we have received your notice, normally within 48 hours.
  • Once we have confirmed that the notice is complete, we promptly remove the material or disable access to it.
  • Where someone else supplied the material, we let them know that it was removed.
  • If we receive a valid counter-notice (section 4), we send a copy to the person who sent the original notice, and restore the material 10 to 14 business days later unless that person tells us in the meantime that they have filed a court action to stop the infringement.

4. Counter-notice

If material you supplied was removed because of a mistake or misidentification, you may send a counter-notice to [email protected] with the subject “DMCA Counter-Notice”. It must include:

  1. Identification of the material that was removed, and where it appeared before it was removed.
  2. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of a mistake or misidentification.
  3. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, of any judicial district in which DramaTalks may be found), and that you will accept service of process from the person who sent the original notice.
  4. Your physical or electronic signature.

5. Repeat infringers

Members may not copy, re-upload or redistribute videos from the Service (section 7 of our Terms of Service). In appropriate circumstances, we close the accounts of members who repeatedly infringe copyright.

6. False claims

Knowingly claiming that material is infringing when it is not, or that it was removed by mistake when it was not, can make you liable for damages, including costs and attorneys’ fees (17 U.S.C. § 512(f)). If you are not sure whether material infringes your rights, consider asking a lawyer before you send a notice.
